Terms of sale of branded ceramic advertising for the Horeca/Beauty&SPA industry

 

 

1 General Provisions

1.1. This regulation defines the rules for the sale of branded ceramic products for the Horeca/Beauty&SPA industry by Ivory Ceramics Sp. z o.o. based in Olsztyn, as well as the rights and obligations of the Client.

1.2. By placing an order, the Client accepts the provisions of these regulations.

1.3. We reserve the right to use the completed projects for the purpose of preparing a catalog of our products, presenting the company's offer, placing them on the Ivory Ceramics website, and other purposes of presenting our products.

1.4. The Client has the right to reserve the possibility of using the completed project (product) exclusively in the form of written information.

 

2 Orders

2.1. Orders should be placed in writing: via email to anita.bryl@ivory.com.pl

2.2. Graphic files are exclusively delivered via email.

2.3. It is possible to order products not available in the Gastroprint offer and perform branding on entrusted material.

2.4. The minimum quantity for a single order of products is: 24 pieces. The order processing time is agreed upon each time. Typically, it ranges from 8 to 15 working days.

2.5. Expedited processing is possible (5 working days) under Last Minute production mode. Expedited order processing requires confirmation by the sales representative each time and is subject to additional fees listed in the price list.

2.6. Processing starts upon acceptance of the order along with approved graphic files and confirmation by the sales representative.

2.7. Order confirmation verifies the correctness of the previously agreed order conditions.

2.8. Any changes to the order conditions or order cancellation should be made no later than 24 hours after their acceptance (not applicable to Last Minute orders).

2.9.1 An order is considered fulfilled if there is a deviation/reduction in the quantity of ordered goods by up to 5% of the total ordered quantity. Of course, with consideration of the resulting difference in the invoice. (Information: Random quantity losses occurring during the firing process in high-temperature kilns for printing on porcelain are natural for this process. Therefore, it may happen that at the end of the production of an order, the stock of a particular cup model is depleted). Producing additional pieces is possible only if the decoration technology allows it and the goods are shipped at a later date than the confirmed purchase agreement. The sales invoice is issued for the actually produced edition within 7 days from the date of shipment.

2.9.2 In the event of order cancellation, we reserve the right to deduct from the deposit all costs associated with its execution - preparation and graphic design costs, costs of producing ceramic transfer decals, and others (*table). Order cancellation is excluded after the print firing or complete execution of another decoration form.

3 Prices and Payments

3.1. The prices of branded ceramic products for the Horeca/Beauty&SPA industry are individually determined for each order based on the quantity, type of products, and chosen method of branding. 3.2. The Client receives a quotation for the order along with the order confirmation via email to the email address provided by the Client, with an obligation to confirm its receipt.

3.3. Upon request, we can create a sample product - the cost of creating a sample is according to the price list.

3.4. The first three orders are subject to a 100% prepayment, subsequent ones according to individual arrangements with the sales department.

3.5. Failure to settle obligations on time results in changing the payment method to prepayment for the next order and may result in the suspension of shipping for the next order. For large orders (with a value of 50,000 PLN/net or more) for customers with deferred payment, additional security in the form of a deposit may be required.

3.6. In case of delays in paying the deposit, the order processing times may change proportionally to the delay period.

 

4 Branding

4.1. The process of branding ceramic products for the Horeca industry is carried out according to the graphic design provided by the Client and the technique indicated in the order.

4.2. Decorating techniques are available on our website in the section https://gastroprint.pl/

4.3. The Client is responsible for providing the graphic design in the appropriate format and resolution according to the company's requirements.

4.4. We allow for a 15% color deviation on porcelain compared to the graphic design.

4.5. The company is not liable for the quality of branding if the graphic design provided by the Client is of low quality or does not meet the requirements.

5 Product Certification

5.1. All products offered by us comply with strict standards set out in Regulation (EC) No 1935/2004 of the European Parliament and of the Council of 27 October 2004 on materials and articles intended to come into contact with food, Commission Directive 2005/31/EC of 29 April 2005, and Council Directive 84/500/EEC regarding compliance declarations and criteria for the effectiveness of the analysis method for ceramic products intended to come into contact with food.

5.2. Due to the specificity of the production process of promotional ceramics and the standards set out in the above-mentioned legal acts, only products with the intended print undergo certification testing. However, upon individual request, we can certify any mug with your print in an independent laboratory for a fee.

5.3. If interested, please contact your sales representative. Due to the specificity of the promotional ceramics production process and the standards set out in the above-mentioned legal acts, only products with print are subject to certification testing. We have appropriate safety certificates for our products and decoration technologies.

5.4. Upon your individual request, we will subject any product with your print to testing in an independent laboratory. Such testing and obtaining the relevant certificates are subject to a fee. The cost of the examination is confirmed each time by the sales representative and depends on the scope of the analysis conducted. It is possible to conduct tests for heavy metal migration, resistance to thermal shock, grip strength, product use in a microwave oven, and impact resistance. The mentioned tests concern product safety and confirm the possibility of contact with food. Certification also covers the issue of decoration resistance to dishwasher washing. In such a test, we additionally confirm the warranty we provide in this regard for individual decoration techniques.

 

6 Delivery

6.1. The delivery time of branded ceramic products for the Horeca/Beauty&SPA industry is individually agreed upon with the Client and depends on the quantity and type of ordered products. 6.2. The cost of delivery is determined individually for each order based on the quantity, size, and weight of the products, as well as the place of delivery.

6.3. The company makes every effort to ensure that the order is delivered within the agreed time, however, it is not responsible for delays caused by the carrier.

6.4. Delivery up to 2000 pieces is at the expense of the ordering party. For orders above 2,000 pieces, the delivery is at the expense of Ivory Ceramics to one designated location nationwide.

6.5. In cases where transport is arranged at the expense of Ivory Ceramics, the Client bears all additional costs related to delays and/or refusal of acceptance, which occurred for reasons (in particular, so-called parking costs and any storage, re-transportation costs).

6.6. Deliveries are made to business entities.

 

7 Complaints

7.1. The Client has the right to lodge a complaint in the event of receiving damaged or non-compliant branded ceramic products for the Horeca/Beauty&SPA industry.

7.2. The complaint should be filed in writing within 7 days of receiving the goods.

7.3. The company undertakes to consider the complaint within 14 working days from the date of its submission.

Personal Data Protection

8.1. The company undertakes to protect the Client's personal data in accordance with applicable legal regulations.

8.2. The Client's personal data is processed solely for the purpose of order fulfillment.

 

8 Final Provisions

9.1. The company reserves the right to change this regulation at any time.

9.2. Matters not covered by this regulation are governed by the provisions of applicable law.

9.3. This regulation shall enter into force on [date] and is available on the company's website.
